Under a new law effective today (July 1, 2016), it’s easier for a divorcing spouse to get his/her fair share of a spouse’s public pension or retirement plan in Tennessee. The General Assembly passed a law which requires all public pension and retirement plans to allocate a portion of the member’s benefits to his or her former spouse.
For decades in Tennessee, only private pensions have been subject to division upon divorce, but not public pensions and retirement plans. This is welcome news for family law attorneys and any spouse of a public employee who is contemplating divorce. To read the legislation, click here.
